Copyright & DMCA Policy

Effective Date: October 17, 2026

Elate Artist Collective respects intellectual-property rights and requires artists, users, and customers to do the same.

1. Artist and User Responsibilities

You may submit or publish artwork, images, text, reviews, or other content only if you own the content or have all rights and permissions necessary for the intended use. Elate may remove or disable access to material when it receives a credible infringement complaint or otherwise has reason to believe the material violates law or platform policy.

2. Copyright Complaint

A copyright complaint should identify the copyrighted work, identify and locate the allegedly infringing material, provide the complainant’s contact information, state a good-faith belief that the disputed use is not authorized, state under penalty of perjury that the information is accurate and that the complainant is authorized to act, and include a physical or electronic signature.

Send notices to: Elate Business Concepts Group, LLC, Attn: Copyright / Elate Artist Collective, PO Box 100088, Milwaukee, WI 53210; email art@elategallery.com; telephone 1-414-800-0809.

3. Counter-Notice

If material is removed or disabled in response to a copyright complaint and you believe the removal resulted from mistake or misidentification, you may submit a counter-notice identifying the removed material and its prior location, stating under penalty of perjury your good-faith belief that removal resulted from mistake or misidentification, providing your name, address, and telephone number, consenting to the jurisdiction required by applicable copyright law, agreeing to accept service from the complaining party, and including a physical or electronic signature.

4. Repeat Infringers

Elate has adopted a policy providing for termination, in appropriate circumstances, of accounts of users who are repeat infringers. Elate may consider the nature, frequency, credibility, and resolution of infringement notices and other relevant facts when enforcing this policy.

5. DMCA Safe-Harbor Status

Elate will not represent that it has satisfied all conditions for a federal DMCA safe harbor until the required designated-agent registration and public agent information have been confirmed and the required notice, counter-notice, repeat-infringer, and standard-technical-measures processes are operational. The contact above may be used for copyright concerns in the meantime. If a Copyright Office designated agent is registered, this page will be updated with the registered agent information.

6. Misrepresentations

Copyright notices and counter-notices are legal communications. A person who knowingly materially misrepresents infringement or removal may face liability under applicable law.

7. Other Rights

This policy addresses copyright complaints and does not replace procedures that may apply to trademark, publicity, privacy, contract, or other legal rights.
