Artist Subscription & Billing Terms

Effective Date: October 21, 2026

These Artist Subscription & Billing Terms govern recurring portfolio subscriptions offered through Elate Artist Collective when recurring billing is activated.

Artist Fees Are Nonrefundable

Each authorized monthly membership charge is final and nonrefundable once paid, except where applicable law requires a refund or Elate expressly approves one in writing. Canceling or downgrading stops or changes future charges according to the disclosed subscription terms; it does not ordinarily produce a partial or prorated refund for a paid period. Mandatory cancellation rights, billing corrections, remedies for services not provided, and lawful payment disputes remain available. The separate Artist Fees & No-Refund Policy also covers the one-time activation/publishing fee and tax-compliance processing charges.

1. Current Portfolio Tiers

  • 1–5 artworks: $9.95 per month
  • 6–10 artworks: $14.95 per month
  • 11–20 artworks: $24.95 per month
  • 21–40 artworks: $39.95 per month
  • 41–75 artworks: $59.95 per month
  • 76+ artworks: custom pricing disclosed before enrollment

Recurring subscription billing is not active merely because these terms are published. Before Elate activates recurring billing for an artist, the checkout or enrollment screen will display the applicable price, billing cadence, material renewal terms, and cancellation method.

2. Express Authorization

Elate will not enroll an artist in a recurring charge based solely on acceptance of the Artist Participation & Consignment Agreement. Recurring billing requires a separate affirmative authorization after the material subscription terms are clearly presented and before the payment account is charged.

3. Renewal

Once activated and authorized, a monthly subscription renews automatically each month until canceled, unless the enrollment screen states a different cadence. The artist authorizes Elate and its payment provider to charge the selected payment method for each renewal, subject to applicable law.

4. Tier Changes

If the number of active artworks moves the account into another published tier, Elate will provide the notice and obtain any authorization required by applicable law before increasing a recurring charge. A custom 76+ artwork plan will not be charged until the artist accepts the quoted terms.

5. Cancellation

Elate will provide a simple online mechanism to stop future recurring charges when recurring subscriptions are launched. Cancellation will take effect no later than the end of the then-current paid billing period unless applicable law requires earlier effect. Canceling a subscription does not automatically cancel a separate customer order, refund a past valid charge, or erase records Elate must retain.

6. Failed Payments

If a renewal payment fails, Elate may provide notice, retry payment as permitted, temporarily limit subscription-dependent features, or suspend new portfolio publishing until the account is brought current. Elate will not use a failed payment as authority to impose an undisclosed fee.

7. Fee Changes

Elate may change future subscription pricing prospectively. Existing subscribers will receive advance notice and any consent required by applicable law before a changed recurring amount is charged.

8. No Waiver of Legal Rights

These terms do not waive rights that applicable law makes nonwaivable, including rights governing recurring charges, cancellation, billing errors, or payment disputes.
