Privacy Policy

Effective Date: October 17, 2026

This Privacy Policy explains how Elate Artist Collective, operated by Elate Business Concepts Group, LLC, doing business as Elate Artist Collective (“Elate,” “we,” “us,” or “our”), collects, uses, discloses, retains, and protects personal information when you use our website, applications, artist tools, store, and related services (the “Services”). This Policy is notice of our practices; it is not consent where applicable law requires a separate choice or authorization.

1. Information We Collect

Depending on how you interact with Elate, we may collect account and contact information; artist application and profile information; customer billing, shipping, order, and transaction information; communications and support records; payout destination information; device, browser, IP-address, log, and security data; necessary cookie data; and artwork/product information submitted for gallery operations.

We collect information directly from you, automatically when you use the Services, and from providers supporting payments, tax compliance, fraud prevention, fulfillment, shipping, hosting, email, and other requested functions.

2. Payment Information

When payment processing is enabled, the payment provider presented at checkout processes payment credentials under its own privacy and security practices. Elate’s WordPress records are intended to retain order and billing/shipping information, amounts, payment status, and provider transaction references needed to administer the transaction. Elate does not intend to store full payment-card numbers or card security codes in ordinary WordPress records. If our implementation changes, we will update this Policy to describe the actual practice.

3. Artist Application Portfolio Links

An application portfolio is reviewed through an external link supplied by the applicant. Elate does not require applicants to upload those review images to Elate. The review link is used only for application evaluation and is not a gallery submission. Elate does not intentionally copy or transfer review artwork into permanent gallery storage.

When review is completed, Elate removes the stored portfolio URL and any temporary access instructions from the active application record and retains only a limited audit record showing that authorization was granted, review occurred, and access information was removed. Residual copies may remain temporarily in routine system backups or security records until those backups rotate or are overwritten. Such residual copies are not used for gallery publication, marketing, or ordinary operations. If a backup is restored, Elate will reapply deletion controls where reasonably practicable. Information subject to a legal-preservation obligation may be retained for that purpose with restricted access.

Portfolio review does not authorize publication, marketing, sale, or fulfillment of the linked work. Do not provide account passwords, PINs, or private login credentials as portfolio-access instructions.

4. Tax Information

Elate uses TaxBandits or another disclosed tax-compliance provider to collect applicable tax certificates and taxpayer information through the provider’s designated secure workflow. Elate does not intend to receive or store Social Security numbers, employer identification numbers, completed W-9 or W-8 forms, or comparable tax-form contents in WordPress, ordinary Collective storage, or ordinary support email.

Elate may retain an artist/payee reference, provider submission/reference ID, form type, completion status, verification result where applicable, and workflow timestamps required to administer tax eligibility and payouts. Do not send completed tax forms or tax identifiers through ordinary email, public content, or the general support system.

5. How We Use Information

We use personal information to provide and secure the Services; create and administer accounts; review applications; process orders and payments; provide customer support; manage artwork, publishing, fulfillment, and payouts; administer subscriptions; satisfy tax, accounting, and legal obligations; prevent fraud and abuse; maintain records; improve website performance; communicate operational information; send marketing where permitted; and enforce agreements and policies.

We do not treat account registration, an order, or acceptance of website terms as consent to unrelated optional marketing or tracking where separate consent is required.

6. How We Disclose Information

We may disclose information to service providers performing hosting, website operations, payment processing, tax compliance, cloud storage, email, fraud prevention, printing, framing, fulfillment, shipping, customer support, accounting, or professional services. We provide information relevant to the service being performed and use contractual protections where applicable law requires them.

We may also disclose information when required by law; to protect rights, safety, security, or property; in connection with a merger, financing, restructuring, sale, or transfer of assets; or at your direction or with your consent.

7. Sale, Sharing, and Targeted Advertising

Based on the current site configuration reviewed on the Effective Date, Elate does not sell personal information for monetary consideration and does not currently use advertising tags or cross-context behavioral advertising technology on this site. We did not detect an active advertising or analytics tag on the live home page. If our practices change in a manner regulated as a sale, sharing, or targeted advertising, we will update this Policy and provide any legally required notice, consent, opt-out method, or recognition of applicable opt-out preference signals before or during the covered processing.

8. Cookies and Similar Technologies

The site currently uses WordPress/WooCommerce technologies needed for website, session, cart, security, and account functions. It also loads fonts from Google-hosted font services, which may receive network information such as IP address and browser information when your browser requests those resources. Our current site inspection did not identify active behavioral-advertising or analytics tags. See the Cookie Policy for the current inventory and additional details.

If optional analytics, advertising, or other non-essential cookie categories are introduced, Elate will implement any consent or preference controls required before using them. Where applicable law requires recognition of a valid opt-out preference signal for covered processing, Elate will honor that requirement; compliance is not conditioned on whether an older site configuration already supported the signal.

9. Retention

We retain personal information only as long as reasonably necessary for the purposes for which it was collected and for legal, accounting, fraud-prevention, dispute, contract-enforcement, and security requirements. Application portfolio URLs are removed after review as described above. Account, order, payout, tax-status, and accounting records may be retained for the periods required by applicable law and legitimate recordkeeping needs. Security logs and backups follow operational retention cycles and are not used as active records after the underlying information has been deleted, except when restoration or legal preservation requires otherwise. At the end of the applicable period, information is deleted or de-identified where reasonably practicable and legally permitted.

10. Security and Incident Response

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. No internet transmission or storage system can be guaranteed completely secure. If a security incident triggers a legal notice obligation, Elate will provide notices within the time required by applicable law. Where Wisconsin Stat. § 134.98 applies, notice is provided within a reasonable time and, subject to the statute’s qualifications, not more than 45 days after Elate learns of the covered acquisition.

11. Your Privacy Choices and Rights

Depending on your location and applicable law, you may have rights to request access, correction, deletion, portability, restriction, objection, information about disclosures, or an appeal of a privacy decision, and you may have rights relating to sale, sharing, targeted advertising, profiling, or sensitive information. Submit requests to art@elategallery.com. We may verify identity when appropriate or required and may retain information where an exception or legal obligation applies. We will not unlawfully discriminate or retaliate because you exercise an applicable privacy right.

You may unsubscribe from non-transactional marketing using the unsubscribe mechanism provided. Marketing preferences are separate from legally regulated privacy or cookie choices.

12. Children

The Services are not directed to children under 13, and artist applicants must be at least 18 years old. A general-audience statement does not eliminate obligations arising from actual knowledge of covered collection from a child. If Elate learns that it collected personal information from a child under 13 in circumstances subject to the Children’s Online Privacy Protection Act or another applicable child-privacy law, Elate will stop covered collection, obtain verifiable parental consent where legally required before further covered collection/use/disclosure, and delete information where required.

13. International Users

Elate is based in the United States. Information may be processed in the United States and other countries where service providers operate. Where applicable law requires a transfer mechanism, safeguard, notice, or separate consent, Elate will implement it before making the covered transfer.

14. Changes

We may update this Policy from time to time. The revised Policy will state a new effective date and additional notice or consent will be provided when applicable law requires it. A policy update does not, by itself, authorize a materially different use of previously collected information.
