Artist Fees & No-Refund Policy

Effective Date: October 21, 2026

This policy governs fees charged by Elate Business Concepts Group, LLC, doing business as Elate Artist Collective (“Elate” or the “Collective”). It concerns paid artist participation services, not customer purchases of physical merchandise. Artist applicants are not required to pay the activation fee unless they have been approved and are eligible to enroll.

Conditional Application Payment Authorization and 48-Hour Review

Elate will review a completed artist application within 48 calendar hours after receiving the submitted application and confirmation of the required $49.95 card authorization. The temporary card authorization holds $49.95 of the applicant’s available funds, but Elate does not collect that amount during initial review. If the application is denied, Elate will cancel the uncaptured authorization without charging the $49.95 activation fee. The card issuer determines how quickly reserved funds become available following cancellation. If the application is approved and the authorization remains valid, Elate may capture the $49.95 only after the applicable approval and onboarding prerequisites are met. The WooPayments authorization expires after seven days; if the artist has not completed the remaining required steps before expiration, fresh payment authorization may be necessary. Any separate tax-compliance processing charge must be disclosed before it is collected. A temporary hold does not authorize recurring subscription charges.

1. No Refunds on Artist Fees

ALL ARTIST ACTIVATION, ENROLLMENT, PUBLISHING, AND MEMBERSHIP FEES ARE FINAL AND NONREFUNDABLE once a valid payment is completed, except where a refund is required by applicable law or expressly authorized in writing by Elate. This includes the one-time Artist Activation & Publishing Fee, currently $49.95, and any separately accepted monthly portfolio membership charges. The amount and billing terms displayed at checkout govern the transaction.

Changing your mind, choosing not to submit artworks, submitting fewer artworks than the selected tier allows, voluntary inactivity, a decision to stop participating, or closing an artist account does not create a right to reimbursement of a valid fee for an already-paid period or service.

2. Tax Compliance Processing

If an applicable third-party tax-compliance processing charge is presented separately during checkout, its amount and purpose will be disclosed before payment. It is generally nonrefundable after the corresponding processing service has been performed, except where required by law or when Elate determines that a duplicate or erroneous charge occurred. The applicable amount is not assumed to be zero unless expressly displayed as zero at checkout.

Optional Custom Gallery Design — $250

Accepted artists may use the Collective’s standard gallery rooms as part of their membership. A separate $250 custom gallery-design fee applies only when the artist requests and accepts a different, bespoke-designed room/gallery. It is not a recurring monthly membership charge. The design specifications, delivery terms, any applicable refund or cancellation treatment, and the two-year support commitment for the separately developed portable gallery plugin will be disclosed and agreed before the optional service is ordered. Each room, whether standard or personalized, requires exactly five approved artworks in one category. Compare standard and personalized gallery options.

3. Monthly Subscriptions and Cancellation

Monthly portfolio subscription tiers and their current prices are described in the Artist Subscription & Billing Terms. Recurring charges will not begin merely because an artist has submitted an application or signed a consignment agreement. A separate affirmative authorization is required before recurring billing starts, and the recurring amount, billing interval, renewal terms, and cancellation method must be disclosed at enrollment.

Once recurring subscriptions are operational, cancellation stops future renewals in accordance with the terms presented during enrollment and applicable law. Except where required by law, cancellation does not produce a partial or prorated refund for a billing period already paid. Cancellation requests and legally required remedies will be honored according to the applicable terms.

4. Billing Errors, Nonperformance, and Protected Rights

This no-refunds policy does not deny remedies for unauthorized or duplicate charges, material billing errors, failure by Elate to provide the paid service, fraud, or another situation for which the law requires a refund, cancellation right, or other remedy. Nothing in this policy restricts lawful payment-card disputes, mandatory consumer cancellation rights, or protections applicable to artists in their jurisdiction. Elate may also authorize a discretionary refund in writing.

5. Separate Rules for Customer Artwork Orders

Purchases of physical artworks and other merchandise are governed by the Shipping, Returns, Refunds & Chargebacks Policy and the applicable terms shown at checkout. Those provisions preserve qualifying remedies for damaged, defective, materially incorrect, unfulfilled, or legally refundable orders. No-refunds rules for artist participation fees do not replace those customer protections.

6. Policy Acceptance and Records

This policy and the Terms of Service should be reviewed before paying any artist fee. Elate may record the accepted policy version and payment authorization with the order. Policy changes apply prospectively and do not retroactively alter completed transactions except where lawfully agreed or required.
