Effective Date: October 21, 2026
This Policy applies to customer merchandise orders placed through Elate Artist Collective, operated by Elate Business Concepts Group, LLC, doing business as Elate Artist Collective.
Scope: Merchandise Versus Artist Participation Fees
All merchandise sales are final for change-of-mind purposes, except as this policy or applicable law provides otherwise. Rights and remedies for defective, damaged, incorrect, unfulfilled, or legally refundable items remain in effect. Nonrefundable artist enrollment, activation, publishing, and membership fees are governed separately by the Artist Fees & No-Refund Policy. That artist fee policy does not replace the qualifying merchandise refunds and chargeback protections below.
1. Shipping Time
Elate will state a production or shipment estimate when reasonably available and will maintain a reasonable basis for that estimate. For merchandise orders covered by applicable federal shipment rules, if no shipment time is stated, Elate will use a reasonable basis for shipment within 30 days after receiving a properly completed order. If Elate cannot ship within the promised or otherwise applicable period, Elate will provide the delay notice, revised timing, and cancellation/refund option required by law and will obtain the customer’s consent to a delay when required. If required consent is not obtained, Elate will issue the required refund for the unshipped merchandise.
Carrier transit dates after shipment are estimates unless Elate expressly states that a delivery date is guaranteed.
2. Qualifying Refund or Replacement Reasons
Because many products are custom, print-on-demand, framed, or produced specifically for an order, refunds or replacements are generally limited to qualifying reasons such as: merchandise that arrives materially damaged; a manufacturing or printing defect; an incorrect item, size, finish, or configuration sent by Elate or its fulfillment provider; an order materially different from the approved specifications; confirmed loss in transit; duplicate billing; or another circumstance for which applicable law requires a refund or other remedy.
Change of mind, buyer preference, minor color differences caused by displays or normal printing variation, failure to review approved specifications, or a request made after custom production begins does not ordinarily qualify unless applicable law provides otherwise.
3. Reporting a Problem
Please contact Elate as soon as reasonably possible and, when feasible, within 7 days after delivery for damage, defect, or order-error claims. Prompt reporting helps us document carrier or production issues and obtain photographs or packaging evidence while available. Missing the requested 7-day reporting period does not, by itself, extinguish a claim or remedy that applicable law does not permit the customer to waive.
We may reasonably request photographs of the item, packaging, shipping label, and the reported issue. Do not discard damaged merchandise or packaging until Elate confirms that it is no longer needed for claim review, unless keeping it would be unsafe.
4. Remedy
For an approved claim, Elate may provide the remedy appropriate to the circumstances, which may include repair, reprint, replacement, reshipment, partial refund, full refund, or cancellation. Elate’s remedy selection does not limit a remedy that applicable law makes mandatory or nonwaivable.
5. Returns
Do not return merchandise without authorization. If a physical return is required, Elate will provide return instructions. Responsibility for return shipping depends on the reason for return and applicable law. For an approved Elate/fulfillment error or covered defect, Elate will not require the customer to bear costs that applicable law requires Elate to bear.
6. Refund Method and Timing
Approved refunds are generally issued to the original payment method when available. Refund timing may depend on the payment provider and applicable law. Where the FTC Mail, Internet, or Telephone Order Merchandise Rule applies to an unshipped order, Elate will provide a prompt refund as that rule requires.
7. Chargebacks and Payment Disputes
Customers may contact Elate first so we can attempt to resolve an order issue promptly, but nothing in this Policy waives or restricts lawful rights to dispute a payment with a card issuer, bank, payment provider, or other legally authorized channel. Elate may provide transaction, shipment, communication, and fulfillment records in response to a payment dispute.
8. Fraud or Abuse
Elate may deny a refund request that is fraudulent, materially misleading, duplicative, or based on altered evidence, subject to applicable law. We may suspend an account when necessary to investigate abuse or protect the Services.
9. Contact
